What Permits Do I Need To Sell Prepared Food?

Selling prepared food at the market can be initially confusing because there are multiple government agencies and rules that regulate it. This page breaks it down to the basics.

-- Off-Site Prepared Food
Off-site prepared food is prepared at a location other than the Market. There are three main ways to legally sell off-site prepared food at the Provo Farmers Market.

- Cottage Food Permit
Cottage food permits are issued by the Utah Department of Agriculture and Food (UDAF). They license packaged and labeled prepared foods that are produced at home or in a commercial kitchen.

Having this permit allows you to sell your product anywhere. Vendors with this permit are preferred at the Provo Farmers Market.


- Commercial Permit
Prepared in Utah under the Utah Department of Agriculture and Food's Manufactured or Retail Food Programs. Smaller-scale producers will be allowed at the Provo Farmers Market at our discretion. Large-scale producers will not be permitted.

- No Permit
A limited number of off-site prepared food vendors will be allowed that do not have one of the above permits. These vendors will be required to follow Utah's Home Consumption and Homemade Food Act.

These vendors are limited as they have to operate in a separate location within the Market and because the Market has to take on a basic inspection role to ensure compliance with Utah State law. Because of this, the Provo Farmers Market will only allow vendors with unique and high-quality products to participate with no permit. Because of the extra work involved, vendors under this category will pay increased weekly booth fees.

​Essentially food without permits must be:

*Labeled with the name and address of the operator with certain disclosures printed on it.
*Sold directly to the consumer for home consumption.
Cannot be sold to a commercial or restaurant establishment, or outside the State of Utah.
*Only sell in a separate area of the Farmers Market with disclosure signs posted at each booth.


--On-Site Prepared Food
On-site prepared food is prepared at the market and is intended for direct consumption by the purchaser.

- Temporary Food Permits
A temporary food permit is required by the Utah County Department of Health for vendors who want to make and sell food at the Provo Farmers Market. Utah County requests that you do not apply for the temporary food permit until after you have been accepted as a vendor at the Market. But, we highly recommend that you familiarize yourself with their rules prior to applying to participate at the Market. Learn more.

- Food Trucks
Food trucks are limited at the Provo Farmers Market and must operate under all State and Local regulations.
